ordertune („we“, „us“, „our“) provides algorithmically generated trading signals and market data („Services“) delivered via the Whop platform and/or the Whop mobile application. By subscribing to our Services, you („User“, „you“) agree to be bound by these Terms of Use.

2. No Investment Advice (Financial Disclaimer)

  • Not Advice: The signals and information provided do not constitute financial, investment, legal, or tax advice.

  • No Individual Recommendation: We do not take into account your personal financial situation, risk appetite, or investment goals. All signals are broadcasted identically to all subscribers.

  • No Solicitation: Nothing provided by ordertune constitutes a solicitation, recommendation, or endorsement to buy or sell any financial instrument.

  • Risk of Loss: Trading stocks, options, and other financial instruments involves a high degree of risk. You may lose all or more than your initial investment. Past performance is not indicative of future results.

3. Contractual Partner and Payments (Whop)

  • Merchant of Record: All payments, billing, and subscription management are handled by Whop Payments, Inc. („Whop“). When you purchase a subscription, Whop is your contractual partner for the transaction.

  • Terms of Whop: Your use of the Whop platform is subject to Whop’s own Terms of Service and Privacy Policy.

  • Access: Access to the signals is granted only after successful payment processing by Whop.

4. Digital Content & Waiver of Withdrawal Right

  • Immediate Performance: By purchasing a subscription, you expressly request and consent to the immediate commencement of the Service.

  • Waiver of Right of Withdrawal: You acknowledge and agree that by accessing the digital signals or joining the Whop-gated area, you lose your statutory right of withdrawal (pursuant to EU/UK consumer law) due to the nature of digital content that is not supplied on a tangible medium. No refunds will be issued for the current billing period once access has been granted.

5. Intellectual Property and Use Restrictions

  • Personal Use Only: The signals provided are for your personal, non-commercial use only.

  • Prohibition of Redistribution: You are strictly prohibited from redistributing, publishing, or reselling the signals, data, or content provided by ordertune to any third party. Violation of this clause will lead to immediate termination of access without refund and may result in legal action.

6. Limitation of Liability

  • Service Availability: We host our website on All-Inkl and utilize third-party tools like TradingView and Whop. While we strive for 99% uptime, we do not guarantee uninterrupted access to signals. We are not liable for technical failures of third-party platforms.

  • Trading Losses: ordertune shall not be held liable for any financial losses, damages, or lost profits incurred by the User.

  • Cap on Liability: To the maximum extent permitted by law, our total liability for any claim arising out of these Terms shall not exceed the total amount paid by the User to us (or our payment processor) during the twelve (12) months prior to the event giving rise to the liability.

7. Data Protection

Your data is processed according to our Privacy Policy. Since we utilize Brevo (Germany) for communications and Whop (USA) for processing, you consent to the necessary data transfers required to fulfill this service.

8. Governing Law and Jurisdiction

Hosting (All-Inkl): Our website is hosted by Neue Medien Münnich (all-inkl.com), located in Germany. All-Inkl collects server log files (IP address, browser type, time of access). YouTube with Enhanced Privacy Mode: We embed videos from YouTube (Google Ireland Limited). We utilize the „Enhanced Privacy Mode“ (https://www.google.com/search?q=youtube-nocookie.com). Data is only transmitted to YouTube/Google if you play the video. This processing is based on your consent (Art. 6 (1) (a) GDPR).

Google Analytics 4 We use Google Analytics 4 (GA4), a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland („Google“), to analyze user behavior on our website.

Data Processing and Google Signals: GA4 uses „cookies“ (text files stored on your device) and similar technologies to collect information about your use of our website. This includes your IP address, which is automatically shortened (anonymized) by Google within the EU/EEA before being stored. Additionally, we have enabled Google Signals. This allows Google to process data from users who are signed into their Google Account and have „Ads Personalization“ turned on. This processing enables cross-device tracking and provides us with aggregated demographic data (e.g., age, gender, interests).
