ordertune („we“, „us“, „our“) provides algorithmically generated trading signals, model portfolios, and execution exports („Services“) delivered via our public website ordertune.com, our documentation portal docs.ordertune.com, and our trading application terminal.ordertune.com. By subscribing to or using the Services, you („User“, „you“) agree to be bound by these Terms of Use.

2. No Investment Advice (Financial Disclaimer)

READ CAREFULLY: ordertune is an information service provider.

  • Not Advice: The signals and information provided do not constitute financial, investment, legal, or tax advice.
  • No Individual Recommendation: We do not take into account your personal financial situation, risk appetite, or investment goals. All signals are broadcast identically to all subscribers.
  • No Solicitation: Nothing provided by ordertune constitutes a solicitation, recommendation, or endorsement to buy or sell any financial instrument.
  • Risk of Loss: Trading stocks, options, and other financial instruments involves a high degree of risk. You may lose all or more than your initial investment. Past performance is not indicative of future results. Hypothetical or back-tested performance has inherent limitations.

3. Contractual Partner and Payments (Lemon Squeezy)

  • Merchant of Record: All payments, billing, EU-VAT handling, subscription management, and refunds are processed by Lemon Squeezy LLC („Lemon Squeezy“), registered in Ireland. When you purchase a subscription, Lemon Squeezy is your contractual partner for the transaction.
  • Terms of Lemon Squeezy: Your use of the Lemon Squeezy checkout and customer portal is subject to Lemon Squeezy’s own Terms of Service and Privacy Policy.
  • Access: Access to the Services on terminal.ordertune.com is granted only after successful payment processing by Lemon Squeezy.

4. Digital Content & Waiver of Withdrawal Right

  • Immediate Performance: By purchasing a subscription, you expressly request and consent to the immediate commencement of the Service.
  • Waiver of Right of Withdrawal: You acknowledge and agree that by accessing the digital signals or logging into terminal.ordertune.com, you lose your statutory right of withdrawal (pursuant to EU/UK consumer law) due to the nature of digital content that is not supplied on a tangible medium. No refunds will be issued for the current billing period once access has been granted.

5. Intellectual Property and Use Restrictions

  • Personal Use Only: The signals, model portfolios, and exports provided are for your personal, non-commercial use only.
  • Prohibition of Redistribution: You are strictly prohibited from redistributing, publishing, reselling, mirroring, or sharing the signals, data, or content provided by ordertune to any third party. Violation of this clause will lead to immediate termination of access without refund and may result in legal action.

6. Limitation of Liability

  • Service Availability: We host our public website ordertune.com on All-Inkl (Germany) and our application terminal.ordertune.com as well as docs.ordertune.com on Railway with servers in the Netherlands. Payments are processed by Lemon Squeezy (Ireland). While we strive for 99% uptime, we do not guarantee uninterrupted access to signals. We are not liable for technical failures of third-party platforms.
  • Trading Losses: ordertune shall not be held liable for any financial losses, damages, or lost profits incurred by the User.
  • Cap on Liability: To the maximum extent permitted by law, our total liability for any claim arising out of these Terms shall not exceed the total amount paid by the User to us (or our payment processor) during the twelve (12) months prior to the event giving rise to the liability.

7. Data Protection

Your data is processed according to our Privacy Policy. We use Lemon Squeezy (Ireland) for payments, Brevo (Sendinblue SAS, France) for newsletters and transactional emails, and Railway (servers in Amsterdam, Netherlands) for application hosting. All processors are bound by Data Processing Agreements and, where applicable, Standard Contractual Clauses (SCCs).

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. If you are a merchant or a legal entity, the exclusive place of jurisdiction for all disputes shall be Hamburg, Germany.

2. Data Collection on Our Websites

Website Hosting (All-Inkl): Our public website ordertune.com is hosted by Neue Medien Münnich (all-inkl.com), located in Germany. All-Inkl collects server log files (IP address, browser type, time of access) necessary for the secure and stable operation of the website (Art. 6 (1) (f) GDPR). We have entered into a Data Processing Agreement (AVV) with All-Inkl.

Application & Docs Hosting (Railway, Netherlands): Our application terminal.ordertune.com and documentation docs.ordertune.com are hosted on infrastructure provided by Railway Corp. (US-headquartered) with server location in Amsterdam, Netherlands (EU). Application logs, session data, and database content (PostgreSQL) are processed within the EEA. Railway acts as a sub-processor under Standard Contractual Clauses (SCCs).

Consent Management (Cookie Notice & Compliance): Our cookie consent banner is an in-house solution developed by ordertune and stores your preferences in a first-party cookie on your device. You can view or change your consent settings at any time via the link in our footer.

Contact Form (Contact Form 7): Inquiries sent via our contact form are stored for the purpose of processing and follow-up. Processing is based on Art. 6 (1) (b) GDPR (contractual necessity) or Art. 6 (1) (f) GDPR (legitimate interest). Data is stored securely on our hosting infrastructure at All-Inkl.

Cloudflare Turnstile: To protect our website from spam and automated attacks, we use Cloudflare Turnstile (Cloudflare, Inc., USA). Turnstile verifies the user’s legitimacy without intrusive tracking. Technical data (e.g., browser properties) is analyzed. This is based on our legitimate interest in security (Art. 6 (1) (f) GDPR). Transfer to the USA is secured via SCCs.

YouTube with Enhanced Privacy Mode: We embed videos from YouTube (Google Ireland Limited) using the „Enhanced Privacy Mode“ (youtube-nocookie.com). Data is only transmitted to YouTube/Google if you actively play the video. This processing is based on your consent (Art. 6 (1) (a) GDPR).

3. Google Analytics 4

We use Google Analytics 4 (GA4), a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland („Google“), to analyze user behavior on our website.

Data Processing: GA4 uses cookies and similar technologies to collect information about your use of our website. This includes your IP address, which is automatically shortened (anonymized) by Google within the EU/EEA before being stored.

Google Signals: Google Signals is disabled. We do not perform cross-device tracking based on Google Account data, and we do not receive aggregated demographic data (age, gender, interests) through this feature.

Purpose: We use the collected data to analyze website usage, compile reports on website activity, and optimize our content.

Legal Basis: The use of Google Analytics occurs exclusively on the basis of your consent in accordance with Art. 6 (1) (a) GDPR. You can revoke your consent at any time via our cookie settings.

Data Transfer to the USA: Data may be transferred to Google LLC in the USA. Google relies on the EU-US Data Privacy Framework (DPF) to ensure an adequate level of data protection.

Storage Period: User-level and event-level data linked to cookies or advertising identifiers are stored for a period of 14 months and then automatically deleted.

4. Service Delivery and Payments (Lemon Squeezy)

To process subscriptions and payments, we use Lemon Squeezy LLC (registered in Ireland), our Merchant of Record.

  • Role: Lemon Squeezy acts as the contractual partner for the transaction, handles EU-VAT, billing, and refunds.
  • Data Transfer: When you subscribe, you provide your data (name, billing address, email, payment information) directly to Lemon Squeezy. To fulfil our contract (Art. 6 (1) (b) GDPR), Lemon Squeezy shares subscription metadata with us (e.g., name, email, plan, status).
  • International Transfer: As Lemon Squeezy is part of a US-headquartered corporate group, applicable international data transfers are secured via Standard Contractual Clauses (SCCs).

5. Authentication & Session Data (terminal.ordertune.com)

When you log in to terminal.ordertune.com, we process the following data via our authentication layer (Auth.js / NextAuth):

  • Email address, hashed password, two-factor authentication secret (if enabled).
  • Session cookies and access tokens, stored encrypted in our PostgreSQL database on Railway (Amsterdam, NL).
  • Last-login timestamp and IP address for security monitoring (Art. 6 (1) (f) GDPR).

Legal Basis: Art. 6 (1) (b) GDPR (contract performance) and Art. 6 (1) (f) GDPR (account security).

6. Email Communication (Brevo)

For our newsletter and transactional service emails, we use Brevo, operated by Sendinblue SAS, 106 Boulevard Haussmann, 75008 Paris, France.

  • Legal Basis (Marketing): Explicit consent (Art. 6 (1) (a) GDPR) via Double-Opt-In for newsletters.
  • Legal Basis (Transactional): Contract performance (Art. 6 (1) (b) GDPR) for account and payment-related emails.
  • Tracking: Brevo may track opens and clicks via a tracking pixel and link redirects, based on your consent.
  • Hosting: Brevo stores your data on EU servers.
  • Unsubscribe: Possible at any time via the link in each email.

7. Data Processing as a Signal Provider

We process only the metadata necessary to grant access to subscriber-gated signals (name, email, subscription tier, access level). Personal data remains within the secure environments of our specialized partners (Lemon Squeezy, Brevo, All-Inkl, Railway).

8. Your Rights

Under the GDPR, you have the right to: Access, Rectification, Erasure, Restriction of Processing, Data Portability, and Objection. You also have the right to lodge a complaint with a supervisory authority. To exercise these rights, please contact legal (at) ordertune (dot) com.

We use SSL/TLS encryption for all data transfers between your device and our servers, as well as encrypted-at-rest storage for credentials in our database. However, no method of transmission over the internet is 100% secure.
